General Terms and Conditions (GTC)
Delía Pole Dance Studio, Rosenheim
1. Registration and course booking
Registration for a course, taster session, or workshop is binding initially by email to the address given on the website or via the contact form there. By submitting a registration, the participant confirms that they have read, understood, and accepted these General Terms and Conditions (GTC).
After the first contact, and after attending a taster or first course, further communication and organisation usually takes place via WhatsApp or the Eversports booking system.
A written contract signature is not required.
A legally binding contract is formed upon registration – whether by email, WhatsApp, or Eversports.
The participant is responsible for reading the GTC, understanding the booking terms, and considering the risk of personal unavailability.
2. Cancellation
A booked course can be cancelled free of charge up to 10 days before the course start. For later cancellations – for any reason, including illness, work, travel, pregnancy, or other personal circumstances – the full course fee is payable. Dropping out of a running course does not entitle the participant to a (partial) refund.
3. No statutory right of withdrawal
Under Sec. 312g (2) no. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for leisure services with a fixed date or period. This applies in particular to all courses, workshops, taster sessions, bachelorette (JGA) events, and other time-bound offers. By booking, the participant acknowledges that withdrawal is not possible.
4. Prices and payment
The course fee is payable in advance, without deduction – by bank transfer or in cash. Payment must generally be received in full at least 7 days before the course start. If the studio sends information or confirmations later for organisational reasons, the payment deadline may be adjusted. A later deadline is only valid with the studio’s express agreement.
All prices are shown at registration and are confirmed with the booking. They apply to the course period or booked date.
Price changes for future course periods are reserved.
5. Late payment, reminders, and collection
If the participant is in default of payment, a payment reminder is sent first. If payment is still not received, a formal reminder with a deadline follows. From default, statutory default interest and reminder fees may be charged in accordance with Sec. 288 BGB. After unsuccessful reminder, the claim may be passed to a collection service or lawyer. The participant bears all additional costs arising.
6. Missed sessions and make-up training
Missed course hours can be made up a maximum of 3 times per course block – only in Open Pole training and within 8 weeks of the missed hour. After that, the entitlement lapses. No refunds for missed hours.
7. Open training (Open Pole)
Open Pole is self-led training in defined time slots. It must be booked in advance via Eversports and is subject to a fee, unless it is a make-up session under section 6. Book early, as places are limited.
8. Workshops and pole camps
The workshop fee is due within 5 days of booking confirmation. No refund after payment, for any reason. The place may be transferred to a substitute person.
9. Taster sessions
Taster sessions must be paid in advance. Cancellation is possible up to 10 days in advance; the fee is credited to a new date. For later cancellation or no-show, the fee is forfeited. No refund.
10. Bachelorette events (JGA)
A JGA booking can be cancelled free of charge up to 3 weeks before the date. Up to 2 weeks before, 50% of the booked service is due. For cancellations with less than 2 weeks’ notice, the full amount is due. After booking and payment, there is no entitlement to a refund of individual guest places, regardless of group size or reason for cancellation.
11. Vouchers and passes
Passes as well as flexibility and fitness cards are valid for 12 months and are non-transferable. All gift vouchers are also valid for 12 months.
12. Minors
Participation of minors requires written consent from a parent or legal guardian.
13. Liability
Participation in all training, courses, workshops, and other offers is at the participant’s own risk. It is explicitly noted that training on the pole and stretching can cause bruising, skin abrasions, or muscular issues. Physical or mental conditions that may increase training risks must be communicated to the instructor in advance.
The participant is responsible for adequate health insurance cover.
The studio is not liable for injury, accident, or damage due to the participant’s own conduct.
14. Photo and video
The studio regularly creates photos and videos for training and marketing purposes and may publish them on online channels (e.g. website, Instagram). Participants who do not wish to appear must state this before the session or before recording and stay outside the frame. If a person remains visibly in the frame without objection, this is deemed consent to use of the image for the purposes stated above.
Requests to remove or adjust content already published may be reviewed; there is no entitlement to deletion.
15. Data protection
Personal data is processed only to organise and provide booked services and for internal studio administration, and is not passed to third parties unless legally required.
Consent to data processing can be withdrawn at any time for the future. Withdrawal does not affect the lawfulness of processing before withdrawal.
Data is stored in line with legal retention requirements and is not automatically deleted.
16. Governing law and jurisdiction
German law applies. Place of jurisdiction for all disputes from the contract – insofar as permitted by law – is Rosenheim.
The GTC also apply if they were not expressly confirmed, provided a booking was made.
